Appeal against findings of disability discrimination and unfair dismissal. Both appeals were allowed and the decisions set aside.

Appeal against a finding of disability discrimination. Appeal dismissed.

Dominique v Toll Global Forwarding Ltd UKEAT/0308/13/LA
Appeal against the dismissal of the claimant’s claims of being unfairly selected for redundancy and that his dismissal was an act of disability discrimination. Appeal allowed on a very narrow point only.

The Charity Commission v Orbison UKEAT/0511/12/JOJ
Appeal against decision that the claimant, disabled within the meaning of the Equality Act, had been unfairly constructively dismissed in cirucmstances where it was submitted that the employer had failed to make a reasonable adjustment by requiring he claimant to attend a meeting with his line manager and so was a breach of contract. Appeal allowed on the issue of breach of contract and case remitted for futher hearing on issue of discrimination.

Hainsworth v Ministry of Defence [2014] EWCA Civ 763
Appeal against the dismissal of the appellant’s claim that the respondent was obliged to make adjustments to a PCP applied to her, to enable the claimant's disabled daughter to undergo training and education. Appeal dismissed.

Newham Sixth Form College v Sanders [2014] EWCA Civ 734
Appeal against the setting aside of an ET judgment which upheld the claimant’s claim of discrimination because of the respondent’s failure to make reasonable adjustments, and against the remittance of the matter to a fresh Tribunal. Appeal dismissed.

Mears Group PLC v Vassall UKEAT/0101/13/LA
Appeal against findings that the respondent had unfairly dismissed the claimant and had failed to make reasonable adjustments for his disability. The unfair dismissal appeal was dismissed but the reasonable adjustment appeal allowed.
