Frame v Governing Body of the Llangiwg Primary School and another UKEAT/0320/19/AT

Appeal against the ET’s decision dismissing the Claimant’s claims of unfair dismissal and wrongful dismissal. Appeal dismissed.

The Claimant, a head teacher with Special Educational Needs Co-ordinator ("SENCO") responsibilities, faced allegations concerning child-care provision and SEN provision at the school. Disciplinary proceedings found that the allegations were substantiated and the Claimant was summarily dismissed for gross misconduct. She brought claims in the ET for unfair dismissal and wrongful dismissal, but they were dismissed. The Claimant appealed on the grounds that the ET had failed to take into account material evidence, and had failed to give adequate reasons for its findings, and she submitted that it was relevant that the ET took over six months to provide its judgment.

The EAT held that the ET had not erred in law, and that the appeal would be dismissed on all grounds.
