Appeals against 3 decisions of the ET (1) dismissing a claim of victimisation, (2) declining to vary the first decision on reconsideration, and (3) striking out complaints of race discrimination, victimisation and being subjected to detriment on the grounds of protected disclosures. Appeal allowed in part.

The Claimant, who is a serving Detective Constable, raised a number of grievances, leading to a single complaint of victimisation being heard by the first Tribunal. The complaint was dismissed, and an application for reconsideration of the first Tribunal's decision was refused. In separate proceedings before a second Tribunal, the Claimant brought claims of race discrimination and referred to a "whistleblowing claim regarding breach of legal obligations and concealment of criminal offences", but these claims were struck out as having no reasonable prospect of success. The Claimant appealed against all of the decisions.

The EAT dismissed the appeals against the decisions of the first Tribunal. However, it held that the second Tribunal had erred in a number of respects in concluding that the complaints had no reasonable prospect of success; accordingly, the matters that had been before the second Tribunal would be remitted to a fresh ET.
