June 2014 CPD Questions

The questions this month relate to the following cases:

[Rodriguez-Noza v Abertawe Bro Morgannwg University Health Board ]()[2013] EWCA Civ 1860
Appeal against an order by the EAT that not only the issue on which the ET had erred should be remitted to the ET but also the issue the EAT had upheld. Appeal allowed.

[Hainsworth v Ministry of Defence ]()[2014] EWCA Civ 763
Appeal against the dismissal of the appellant's claim that the respondent was obliged to make adjustments to a PCP applied to her, to enable the claimant's disabled daughter to undergo training and education. Appeal dismissed.

[Newham Sixth Form College v Sanders ]()[2014] EWCA Civ 734
Appeal against the setting aside of an ET judgment which upheld the claimant's claim of discrimination because of the respondent's failure to make reasonable adjustments, and against the remittance of the matter to a fresh Tribunal. Appeal dismissed.

[Burrell v Micheldever Tyre Services Ltd ]()[2014] EWCA Civ 716
Appeal against a decision by the EAT to substitute its decision for that of the ET, which had found in favour of the claimant, rather than remitting the matter back to the ET. Appeal allowed and the matter was remitted to the original ET.

[Ajar-Tec Ltd v Stack ]()UKEAT/0293/13/DA
Appeal against a ruling that the claimant, who was a shareholder and director of the company, was an employee and worker. Appeal allowed and remitted to a fresh Tribunal.

For each question answered correctly 10 minutes of CPD is added to your training record so if you answer all 12 that will give you 2 hours.

Barristers: please note that, according to BSB rules, you will have to answer at least 3 questions correctly, equivalent to 30 minutes, for the training to count towards your CPD requirements.
