October 2013 CPD Questions

This month's CPD questions relate to:

[JJ Food Services Ltd v Zulhayir**]() [2013] EWCA Civ 1226
**Appeal against EAT decision remitting unfair dismissal and disability discrimination claims back to the ET for a remedy hearing where the ET had already dismissed the claims. Appeal allowed.

[Abercrombie & Ors v Aga Rangemaster Ltd**]() [2013] EWCA Civ 1148
**Appeal against a decision, which was upheld by the EAT, that employees who had agreed to a temporary reduction in their working hours during a period of economic downturn, were not entitled to guarantee payments for the day they did not work. Appeal allowed.

[Borrer v Cardinal Security Ltd**]() UKEAT/0416/12/GE
**Appeal against a ruling that the claimant had not been unfairly constructively dismissed, nor had the respondent made unlawful deductions, and as there was no dismissal he had no entitlement to notice pay. Appeal allowed and remitted to the same Tribunal.

[Lorne Stewart Plc v Hyde & Ors**]() UKEAT/0408/12/GE
**Appeal against a finding that the two claimants had transferred to the transferor because both were found to have been assigned to an organised grouping of employees which was the subject of a service provision change. Appeal dismissed.

For each question answered correctly 10 minutes of CPD is added to your training record so if you answer all 12 that will give you 2 hours.

Barristers: please note that, according to BSB rules, you will have to answer at least 3 questions correctly, equivalent to 30 minutes, for the training to count towards your CPD requirements.
