2.5 hours worth of CPD questions covering cases published in June 2013

This month's CPD questions relate to:

[North & Ors v Dumfries & Galloway Council ]()[2013] UKSC 45
Appeal in Equal Pay proceedings about whether the comparators chosen were in the same employment as the claimants. Appeal allowed and the original decision of the ET, that they were, restored so that the claims could proceed.

[British Car Auctions v Adams]() UKEAT/0159/12/SM
Appeal against the refusal of the ET to recuse itself after it became known that one of the lay members of the panel had a family connection with an employee who featured in the case and his son was also employed by the respondent. Appeal allowed and the case was re-listed before a different Tribunal.

[City and County of Swansea v Gayle]() UKEAT/0501/12/RN
Appeal against a finding of unfair dismissal where the respondent employer had secretly filmed the claimant not being at work when he said he was, thus breaching his Article 8 rights. Appeal allowed and the finding was set aside.

[Johnson v Oldham Metropolitan Borough Council ]()UKEAT/0095/13/JOJ
Respondent’s appeal against a decision of the ET that an unless order had been complied with. Claimant’s appeal against a ruling that one of two ET claims should be stayed until concurrent proceedings in the High Court had been concluded.

[Cook v Building Establishment Research Ltd]() UKEAT/0493/12/DM
Appeal against an order for costs after the claimant withdrew his claims for contractual and statutory redundancy payments. Appeal allowed and costs order set aside.

[Sobhi v Commissioner of the Police of the Metropolis]() UKEAT/0518/12/BA
Appeal against a decision that the claimant was not disabled at the relevant time and her claim of disability discrimination was dismissed. Appeal allowed.

For each question answered correctly 10 minutes of CPD is added to your training record so if you answer all 15 that will give you 2.5 hours.

Barristers: please note that, according to BSB rules, you will have to answer at least 3 questions correctly, equivalent to 30 minutes, for the training to count towards your CPD requirements.
