Lewis v Dow Silicones UK Ltd: [2024] EAT 51

Second appeal arising from a TUPE claim where the claimant was saying he had been unfairly dismissed after a change of working conditions but the respondent said the change was necessary to effect wider business changes.

HHJ Tayler allows the appeal largely because the respondents had not pleaded that the principal reason for dismissal was because of the wider business changes. The claim was remitted to a new Employment Tribunal to determine remedy.
